Not to be pedantic guys.

But Oliver Holmes never wrote opinions dealing with pornographic movies. The line quoted was offered up by Potter Stewart decades after Holmes demise

And I don’t think walking the street affects your Fifth Amendment right– generally thought of as the right of the accused to expect due process from the State and to be protected from the overwhelming power of the State when accused. Can’t see how a dispute between private individuals comes into play there.

And in the case cited by Lorenzo as allowing photographers to take pictures in New York public spaces, the judge actually never reached that issue. He decided that the subject of the photograph had brought his claim too late, so there was no need to make a ruling on whether one can make use of someone’s image merely because they were in a public space.

And has he ever heard of the concept of editing? Do we need another 100 images of cabs smearing through the night or 50 images of women’s shoes when 1 or 2 would make the point?
